The Genie History Founded in 1923 as the Alliance Manufacturing Company, the production included a broad line of consumer, industrial and military products. You are able to prevent our App from accessing these features upon installation or through the device settings. When you create a user profile on the App, you may be asked to provide your name, email address, telephone number, and/or other information. A record of your controller commands, quality of your data connection, door operation history, and other technical information may be stored within the App and may be accessible through Genie’s customer service portal. Genie’s authorized employees may also have access to this information. Genie’s use of any such information will comply with this Policy. Digital Voice Assistants. If you want to control your Aladdin Connect product through a voice control service like Amazon Alexa or Google Assistant, we may also need to collect system logs that capture usage information, detailed device data, and other account details. When you choose to connect your Aladdin Connect device to a third-party service we may share your account data and usage data with that service. In such cases, the use of your data is governed by the privacy policy of that third-party service. Social Media. Genie may use your information to interact with you on third party social networks such as Facebook, Instagram, LinkedIn, and Twitter or video-sharing sites such as YouTube; or for the purpose of giveaways or providing you information, promotions, and offers. Provided we have obtained your prior consent we may post your testimonials on our Site and social networks. Reese’s Law was signed by President Biden on Aug. 16, 2022, and mandates federal safety requirements for button cell and coin batteries. The intent of this new rule is to eliminate or adequately reduce the risk of injury from ingestion of button cell or coin batteries by children six years of age and younger. These batteries are used in many types of consumer products from keyless entry remotes and wireless game controllers to toys and musical greeting cards. Pursuant to Reese's Law, CPSC voted to adopt the voluntary standard, ANSI/UL 4200A-2023 Standard for Safety for Products Incorporating Button Batteries or Coin Cell Batteries, as the mandatory consumer product safety rule for consumer products containing button cell or coin batteries. The Commission also established labeling requirements for button cell or coin battery packaging, to warn of the ingestion hazard to children. The stakes are high and the consequences of a child swallowing a button cell or coin battery can be immediate and deadly. These tiny batteries can burn through a child’s throat or esophagus in as little as two hours if swallowed. From 2011 through 2021, CPSC is aware of 27 deaths and an estimated 54,300 injuries treated in emergency rooms associated with ingested or inserted button cell or coin batteries. INDEMNITY The User agrees to indemnify and hold Genie and its affiliates harmless from and against any and all claims, losses, liability, costs, and expenses (including, but not limited to, attorneys' fees) arising from the User's violation or breach of these Terms, arising from the User's violation of any third party's rights such as trademark, copyright, proprietary and privacy rights, or arising from User's violation of these terms of use or any applicable federal, state or local law, regulation or ordinance. This indemnification and hold harmless obligation will survive the termination of these Terms. GENERAL The User's access to and use of this Site and information available on or through this Site are subject to and shall be governed by and construed in accordance with all applicable federal laws of the United States and applicable laws of the State of Ohio and local governmental entities. Genie and User irrevocably consent to the exclusive jurisdiction of the courts located in Holmes County, Ohio and the federal courts situated in the State of Ohio in connection with any action arising under or in connection with these Terms or relating to the User's access of this Site, or any information available on or through this Site. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this agreement, including without limitation this paragraph and the warranty disclaimers and liability exclusions above. Genie has endeavored to comply with all legal requirements known to it in creating and maintaining this Site but makes no representation that materials on this Site are appropriate or available for use in any particular jurisdiction. Use of this Site is unauthorized in any jurisdiction where all or any portion of this Site may violate any legal requirements and you agree not to access this Site in any such jurisdiction. You agree that Genie may at any time and without notice change the terms and conditions and notices under which this Site is offered. Genie’s performance of this agreement is subject to existing laws and legal process and nothing contained in this agreement is in derogation of Genie’s right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by Genie with respect to such use. GMI Holdings Inc., dba The Genie Company (“Sponsor”) SWEEPSTAKES OFFICIAL RULES (“Official Rules”) By participating, entrants agree to these Official Rules and accept decisions by Sponsor as final. NO PURCHASE REQUIRED. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. QUALIFICATIONS. Entries are limited to one per person. The Sweepstakes is open only to persons who are age 18 or older as of the date of entry, who are legal residents of, and physically located within, the 50 states, the District of Columbia, or Canada, excluding Quebec (“Territory”), and who are not employees of Sponsor, or its parent, subsidiaries, affiliates or the advertising, promotional or fulfillment agencies of any of them, nor members of their immediate families or same households. VOID WHERE PROHIBITED BY LAW. This Sweepstakes is subject to all federal, state, and local laws and regulations, and is void where prohibited or restricted by law. ENTRY PROCESS. Entrants must submit their name, telephone number, email address, via the online entry form. Upon submission, an entrant will be automatically entered into the Sweepstakes. Entrants must complete all nonoptional data requested on the online entry form. Incomplete entries are void. All entries must be received by midnight, Central Standard Time, August 5th, 2024. The Sweepstakes begins at 12:01 a.m., Central Standard Time, August 1st, 2024, and ends at 11:59 p.m. Central Standard Time, August 5th, 2024 (the “Entry Period”). All entries must include a valid email address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of dispute as to the identity or eligibility of the winner based on an email address, the winning entry will be the “authorized account holder” of the email address submitted at the time of the entry. The “authorized account holder” is the person to whom the applicable Internet service provider or other organization for assigning the email address has associated with the submitted email address. Sponsor is not responsible for and/or the following will cause an entry to be disqualified: (a) entries from persons residing or located outside the Territory; (b) inaccurate, forged, incomplete, lost, tampered with, misdirected, delayed or late entries; (c) miscommunications; failed phone, computer hardware or software or telephone transmissions; (d) technical failures; (e) unauthorized human intervention; (f) traffic congestion; (g) garbled or jumbled transmissions; (h) or other errors of any kind, whether due to electronic, mechanical or human error or other causes. Entries will not be acknowledged or returned, and entries are the property of Sponsor. Sponsor shall have the right to use, assign, edit, modify, or dispose of any entry however it sees fit, without approval of the entrant. Sponsor may send a communication to the entrant about whether they won the contest and include a promotional offer. To the extent permitted by law, by participating in the Sweepstakes and providing such personal data, entrants consent to Sponsor’s collection and usage of their personal information, and entrants acknowledge that they have read and accepted Sponsor’s privacy policy. DISQUALIFICATION OF ENTRANT. Should Sponsor determine, in its sole discretion, that any entrant has violated any of the provisions in the Official Rules, Sponsor shall have no obligation to award a prize to such entrant. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of the website, acting in violation of these Official Rules or any federal or state, law, rule or regulation or acting in an unsportsmanlike or disruptive manner or with the attempt to annoy, abuse threaten or harass any other person. PRIZES. The prize will be one (1) garage door opener in original packaging (installation excluded), to be selected by the winner between the following models 7155D-TSV, 3155D-TSV, 4063B-TKV, 6172H-B. With an approximate retail value of $499.00. Ten (10) winners will be selected on August 6th, 2024. The prize is not redeemable for cash and is non-transferable. No prize substitution is allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. No more than the advertised number of prizes will be awarded. If, by reason of printing or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. PROCEDURES. The winners will be selected on August 6th, 2024, at Sponsor’s headquarters located at 1 Door Dr., Mount Hope OH 44660, in a random drawing from the submitted entries. The odds of winning depend upon the number of eligible entries received. NOTIFICATION OF WINNER. The winner will be notified by telephone or e-mail by a representative of Sponsor on or about August 16th, 2024. If the winner is from Canada, he or she must correctly answer a mathematical skill-testing question as a condition precedent to receiving the prize. Sponsor is not responsible for any inability of the winner to accept or use the prize for any reason. Disqualification and the selection of an alternate winner will result from any of the following: (a) failure of a potential winner to execute and return a publicity release form within 14 days from the date of notification; (b) the return of any other notification of a prize as undeliverable; (c) the potential winner’s failure to claim the prize within 14 days from the date of notification by Sponsor; (d) the failure of a winner from the Canada to correctly answer the skill-testing question; or (e) any other non-compliance with the Official Rules. Any prize not accepted by the winner will be forfeited and Sponsor reserves the right to select another winner from the eligible entries upon the occurrence of the forgoing. CONDITIONS. RIGHT TO CANCEL. Sponsor reserves the right to cancel or modify the Sweepstakes in the event that: (a) this Sweepstakes is challenged by any legal or regulatory authority; (b) fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the security, fairness, integrity, or proper conduct of the Sweepstakes, as determined by Sponsor in its sole discretion; (c) the Sweepstakes is not capable of completion as planned for any reason, including because of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort; (d) any other cause corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, as determined by Sponsor in its sole discretion. In any such event, Sponsor reserves the right to award the prize at random from the eligible entries received up to the time of the impairment.
